US Government Lawyers fouled up big time in the St Louis Ka Nefer Nefer mummy mask case. Now it seems they've been caught out by Eric Procopi's lawyers over the Tarbosaurus. See Rick St Hilaire's post of September 9, 2012: "New York Federal Court Raises Questions in US v. Tyrannosaurus Bataar Skeleton". The court has been led to "call into question some of the assumptions in the government's Verified Complaint". The first point concerns (as it could earlier be suggested would happen) what was imported and what is contested ("the Display Piece"). They really should have paid more attention in the investigations, as I said, to those other Mongolian fossils being sold by Tarby's seller. The court also asks whether T. bataar could not have wandered over the border and be found in China. The government also has to prove that if laws were broken, the importer had knowledge that the law was being broken. Round one to Peter Tompa and Michael McCullough. Could be interesting.
