The ACCG Still Going on About the Same Old Junk


For the latest on the embarrassing series of court battles by the ACCG "that have dealt the trade organization successive defeats in federal district court, the circuit court of appeals, and the U.S. supreme court", see Rick St. Hilaire"Litigants Remain Far Apart in Ancient Coins Forfeiture Case" Cultural Heritage Lawyer blog Tuesday, August 6, 2013. This is now about:
U.S. v. Three Knife-Shaped Coins, Twelve Chinese Coins, and Seven Cypriot Coins
The question is whether these coins (in reality the ACCG who bought them from Spink's) are going to be able (or should be able to) re-litigate many if not all of the issues that have already been addressed by other courts. Let's hope not and let is see an end to this madness.

There are four questions, and only four questions, the court has to ask and answer in this case: these are coins of a certain designated type (yes or not?), imported into the USA at a certain time (yes or no?) when certain formalities were stipulated for just such items (yes or no?) and the importer - in collusion with the exporter - failed [nay, refused] to comply with those formalities (yes or no?) making it impossible for them to pass US customs control legally. What is there further to be discussed?
